My Little Pony Colouring Competition

1. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions. Entry into the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion Entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take a Prize if they are drawn as a Winner.

2. The Promoter is Weatherbeeta Pty Ltd (ABN 77 006 752 692) of 8 Moncrief Road, Nunawading VIC 3131. Ph: 1800 021 980 (Promoter).

3. These Terms and Conditions shall be governed by the laws of Victoria, Australia and any dispute shall be subject to the exclusive jurisdiction of the Australian courts.

Duration

4. Entry to the Promotion commences at 9:00am AEDT on 4/11/23 and closes at 11.59pm AEDT on 13/11/23 (Promotion Period).

Eligibility to Enter

5. Entry is free and no purchase is necessary to participate.

6. The competition is open to all residents of Australia (Eligible Entrants).

7. Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion. These Conditions of Entry will bind the Entrants and any parent or legal guardian who gives their consent.

8. WeatherBeeta employees and their immediate family members are not eligible to enter the Promotion. Immediate family includes only spouses, parents and children.

9. The Promoter reserves the right, at any time, to verify the validity of Entries (including an Entrant's identity, age and place of residence) and to disqualify any entrant who is not an Eligible Entrant, has not complied with these Terms and Conditions or tampers with the entry process.

Entry into the Promotion

10. To enter Eligible Entrants must complete the following steps (Entry):

        1. Colour in a WeatherBeeta x My Little Pony colouring sheet.

        2. Take a photo and post to a public Instagram account.

        3. Tag #HLMyLittlePony and your local Horseland Store’s Instagram account in the post caption.

        4. If you don’t have a local store, tag @horseland_official to enter for the Online Horseland Store.

11. Entries must be the original works of the Entrant.

12. Obscene, provocative, or otherwise inappropriate content will not be considered. The Promoter retains sole discretion as to what constitutes inappropriate content.

13. The Promoter is not responsible for (and is under no obligation to accept) any lost, late, incomplete or misdirected Entries.

14. The time of Entry will be deemed to be the time the entry is received by the Promoter.

Determination of Winners

15. This promotion is a game of skill and Winners will be drawn based on creativity of colouring and quality of photo/s used for their Entry, in accordance with clauses 17 and clause 30 (if applicable).

16. Winners will be picked by a judge at each Horseland Store location by 5:00pm AEDT on 15/11/23.

17. All valid Entries received during the Promotion Period will be eligible for the draw.

18. There will be a total of 4 x Winners per Horseland Store, including the online store.

19. Entrants can only win once in this Promotion.

20. The result of the draw is final and no correspondence will be entered into.

The Prizes

21. The Winners will each receive:

              1 x My Little Pony Ribbon Hairstyles Sunny Starscout toy valued at RRP $34.99

              1 x My Little Pony activity book valued between $7.99 and $12.99

22. Total prize pool value at each Horseland Store is RRP $180.92 (AUD). 

23. Under the Australian Consumer Law, there are some warranties and guarantees that cannot be excluded, restricted or modified or can only be excluded, restricted or modified to a limited extent. The Promoter excludes all warranties and guarantees in relation to the prizes, to the extent allowable under the Australian Consumer Law. Except as otherwise required under the Australian Consumer Law, the Promoter accepts no liability or responsibility for any defect with the prizes.

24. Prizes are not exchangeable or redeemable for cash.

25. If a Prize (or part of a Prize) is unavailable for any reason, the Promoter, in its discretion, reserves the right to select an alternative prize of similar value which will be awarded to the relevant Winner, subject to any written directions from a regulatory authority.

26. The Promoter accepts no responsibility for any tax implications that may arise from the promotion or the prizes. Independent financial advice should be sought.

Notification of the Winners

27. The Winners will be notified via the Instagram account used for their Entry by 5:00pm AEDT on 15/11/23.

28. Winners will be required to visit the Horseland Store to claim their prize. If the Entry was for the Online Horseland Store, the prize will be sent via Australia Post to an eligible delivery address.

29. The Winners names and entries will be featured on Horseland’s social media accounts. By entering, participants agree to their names and content being shared with no right to claim usage costs or fees.

Right of the Promoter to redraw

30. The Promoter reserves the right to re-select a Winner in the event of a Winner not being an Eligible Entrant, not having complied with these Terms and Conditions or not being able to be contacted by the Promoter after the Promoter having made reasonable efforts to do so. If a redraw is necessary, it will be conducted 7 business days after the Winners have been notified, subject to any written direction given under applicable law. Any Winner determined in accordance with this clause will be notified via the Instagram account used for their Entry within 2 business days of the redraw.

Limitation of liability and variation of promotion

31. Except as otherwise required by law, if any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend this promotion and these Terms and Conditions.

32. Except for any liability that cannot be excluded by law, the Promoter, its related bodies corporate and their respective officers, employees, contractors and agents will not be liable for any losses (including loss of opportunity), damages, expenses, costs or personal injuries arising out of or in connection with this Promotion, or the use of any Prize.

Entry details and privacy

33. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at https://www.horseland.com.au/privacy-policy/

Third party promotion

34. This Promotion may be promoted through third party websites, like Facebook and Instagram. Entrants must at all times comply with the terms of service for those third-party websites when using them to participate in this Promotion. This Promotion is in no way sponsored, endorsed or administered by, or associated with those third-party websites.
